Role as platform operator (intermediary)

Nutze.app acts exclusively as an online marketplace and intermediary. Through the platform, private and commercial users can offer and rent items. Rental contracts are concluded exclusively and directly between the respective users. Nutze.app (Chris Wernsmann) does not itself become a party to the rental contracts and assumes no liability for the condition of the rented items or the conduct of the users. Commercial providers are obliged to provide their own legal notice (Impressum) and their own terms and conditions in their profile or listing.

Consumer dispute resolution / universal arbitration board

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

Liability for content

As a service provider, we are responsible for our own content on these pages in accordance with § 7 (1) DDG under general law. According to §§ 8 to 10 DDG, however, we as a service provider are not obliged to monitor transmitted or stored third-party information (e.g. listings and profile texts of users) or to investigate circumstances that indicate illegal activity.

Obligations to remove or block the use of information under general law remain unaffected. However, liability in this respect is only possible from the point in time at which a concrete infringement of the law becomes known. If we become aware of any such infringements, we will remove the content in question immediately.

Liability for links

Our offer contains links to external third-party websites over whose content we have no influence. We therefore cannot assume any liability for this third-party content. The respective provider or operator of the pages is always responsible for the content of the linked pages. The linked pages were checked for possible legal violations at the time of linking. Illegal content was not recognisable at the time of linking.

However, permanent monitoring of the content of the linked pages is not reasonable without concrete evidence of a legal violation. If we become aware of any infringements, we will remove such links immediately.
